"The ARKathon" Modding Challenge
Terms and Conditions

The ARKathon modding challenge, exclusively for "ARK: Survival Ascended," is a dynamic event designed to inspire and showcase the talents of ARK modders, across both PC and consoles. The challenge is structured to celebrate creativity in multiple aspects and levels of ARK: SA mods and modders.

1. Full dates:

  • Start Date: December 5 - Participants may begin submitting their entries. Note - the ARKathon modders track will also automatically include approved cross-platform ARK: Survival Ascended mods previously published on CurseForge, so their creators don’t need to re-submit them.
  • Submission Deadline: February 5 - The final date for participants to submit their entries. All submissions must be received by this date.
  • Community Voting: February 12 to February 24 - Community Voting Period - During this period, the ARK community can vote for their preferred entries.

2. Phases and Prizes

Modders Track

Eligible Categories:

  • Maps
  • Everything Else - creatures, gameplay mechanics, items, and environmental elements and others.

How to Participate:

  • Sign up as a CurseForge creator.
  • Use the ARK:SA Devkit to develop and upload their cross-platform mods/maps to CurseForge.

How Winners are Chosen:

  • Once submissions have closed, the judges panel will selects 16 finalists:
    • 6 Maps
    • 10 “Everything Else” mods
  • Next, all finalists will be put up for community voting
    • Maps: The top voted map, plus 2 additional maps selected by judges will be named winners
    • Everything else: The top voted “everything else” mod, plus 4 additional mods will be named winners

Judging Criteria:

The judges will select the finalists and winning creations based on:

  • Originality - is it novel? We’ll evaluate how creative, new and unique the mod is (30%)
  • Fun Factor - Is it fun to play with? We’ll evaluate the playability aspect of the mod (30%)
  • Eye catching - Does it make our jaw drop? We’ll evaluate the visual esthetic aspect of the creation (30%)
  • **Bonus points for Popularity - as determined by the number of downloads of the creation on CurseForge at the time of judging. (10%)

Prizes:

  • Each winning map wins $10,000 (3 winners total)
  • Each “everything else” mod wins $4,000 (5 winners total)

Studios Track

Eligible Categories:

  • DLC-level Premium Mods with unique concepts.

How to Participate:

  • Fill this form to submit your preliminary idea. You’ll also be asked to provide some basic information about your team, past work and other data.
  • The CurseForge team will review your proposal, and will reach out with instructions on how to submit your full concept for consideration in the Studios Track.
  • To submit your full concept, you’ll be asked to produce a “Kickstarter-like” video, showcasing your idea, team and vision. You’ll also be asked to submit a GDD - Game Design Document.

How Winners are Chosen:

  • Once submissions have closed, the judges panel will selects up to 10 finalists
  • Next, all finalists will be put up for community voting
  • The top voted concept video, plus 2 additional concepts selected by judges will be named winners

Judging Criteria:

The judges will select the finalists and winning creations based on:

  • Originality - is it novel? We’ll evaluate how creative, new and unique the mod is (30%)
  • Fun Factor - Is it fun to play with? We’ll evaluate the playability aspect of the mod (30%)
  • Eye catching - Does it make our jaw drop? We’ll evaluate the visual esthetic aspect of the creation (30%)
  • **Bonus points for the studio’s background - team size, impressive past work etc. (10%)

Prizes:

  • Each winning studio will receive a $100,000 development grant
  • The development grant is milestone-based, and winning is subject to the studio signing an investment agreement with Overwolf

3. Terms Regarding Submitted Creations for ARKathon

  • All submitted creations must adhere to both CurseForge Moderation Policies and Studio Wildcard's Modding Guidelines. This includes restrictions on the use of protected intellectual property, prohibitions on nudity, etc.
  • Be aware that all mods submitted to CurseForge undergo a moderation process, which could lead to a delay of a few days from submission to publication.
  • When publishing your creations, ensure they are accurately categorized. For instance, do not categorize a “Creature Mod” under “Maps” or vice versa.
  • Failure to meet any of the above requirements may lead to disqualification of your submission and/or revocation of any winnings.

Additional topics:

  • By participating in this event, you agree that we can re-use your submitted images and video clips for promotional event recap videos.
  • Participants must be 18+. Winners must confirm they are 18+ before prizes are fulfilled.
  • Modders track prizes will be claimed via the CurseForge Authors Rewards Program, which lets creators withdraw their monthly earnings or winnings via Paypal or Amazon Gift Cards.

VOID WHERE PROHIBITED, TAXED OR RESTRICTED BY LAW, RULES, REGULATIONS, ORDINANCE, OR INTERNATIONAL PUBLIC POLICY, OR WHERE REGISTRATION, FILING OR NOTICE REQUIREMENTS MAY EXIST (COLLECTIVELY, THE “RESTRICTED JURISDICTIONS”).
OPEN TO ENTRANTS WHO ARE AT LEAST 18 YEARS OF AGE AT OR THE AGE OF MAJORITY IN THEIR JURISDICTION OF RESIDENCE, WHICHEVER IS OLDER.

The following Promotion Official Rules (“Official Rules”) apply to the ARKathon Modding Challenge (for convenience, the "Promotion").

By participating in the Promotion, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Promotion sponsor and operator, Overwolf Ltd., located at 40 Tuval st. Ramat-Gan, Israel (“Overwolf”), which shall be final and binding in all respects (without prejudice to the Entrant’s legal rights and remedies available under applicable law, including the right to commence legal proceedings).

  1. PROMOTION TYPE AND GENERAL DESCRIPTION. This promotion is a contest among participants inviting them to create Mods (“Mod”) on Overwolf’s own proprietary mods creating Platform – the CurseForge (the “Cursforge Platform”) for the game “Ark : Survival Ascended” (the “Game” or “ARK”, which is developed, published and operated by Snail Games USA and hereinafter the “Studio Wildcard”). The Promotion will have two available Submission Tracks: (1) the “Modders Track”, and (2) the “Studios Track” (each will be a “Track”). Submission for each Track is subject to the fulfillment of the Submission Criteria as described in the “How to Enter” in section 4 below and subject to the Eligibility requirement and verification and validation process by Overwolf as detailed in these Official Rules. Mods that will be created and submitted for the Promotion under the Modders Track, will be published on curseforge.com and available for download on ARK cross-platform. Selection of Winners will be following a community voting (the “Vote”) and subject to decision by a Panel of judges (the “Judging Panel”), and all subject to the winner selection process described in these Official Rules. Entitled Winners will receive the Prizes as described in section 7 below.
  2. PROMOTION PERIOD. The Promotion begins on December 5th, 2023 at 00:01 am (PST) and ends on February 5th, 2024 at 23:59 pm PST (“Start Date” and “End Date”, respectively, and together: "Promotion Period").
  3. ENTRANT ELIGIBILITY.
    1. The Promotion is open only to Entrants who are at least 18 years of age or the age of majority in their jurisdiction of residence if older at the time of entry (“Entrant”).
    2. Entries originating from any of the Restricted Jurisdictions are not eligible for entry and cannot be rewarded with a Prize.
    3. Winning a Prize is contingent upon fulfillment of all requirements set forth in the “How to Enter” specified in section 4 herein and a validation and verification process by Overwolf.
  4. HOW TO ENTER. To enter the Promotion and become an “Eligible Entrant” with a chance to win a Prize, an Entrant must complete the following aggregated requirements (“Submission Criteria”) during the Promotion Period:
    1. The “Modders Track” Submission Criteria:
      1. Modders Track is open for Mod creator/s (“Creator”) that wish to submit a downloadable cross-platform Mod for ARK that include one of the following characteristics: (1) a Map Mod (“Map Mod”); (2) Other Mod: which can include creatures, gameplay mechanics, items, environmental elements etc., (“Everything Else Mod”).
      2. In order to submit a Mod for the Modders Track, an Entrant needs to have a Creator Account on the CurseForge Platform and sign-in to the account (“Account”).
        Entrants without an Account may access the following link https://authors.curseforge.com/welcome/ and register. Note: By registering to CurseForge and/or downloading any of the CurseForge Platform’s features to your device (PC only), the Entrant will be subject to and is required to accept the CurseForge Platform and/or Overwolf’s Terms of Use as well as accept Overwolf Developer Terms and Conditions, which are available in the following link: https://overwolf.github.io/topics/legal/legal-developers-terms. The Entrant shall also be required to accept any applicable Privacy Policy that applies to Curseforge and/or Overwolf services (“Services”). Without derogation, all Entrants hereby accept any and all policies, guidelines and rules which may apply on the Services. By Submission of a Mod all Entrants hereby declare and acknowledge that they have read and accept all the terms and agreements that apply to the Services provided to by Overwolf and/or the Curseforge and CurseForge Platform.
      3. Create a cross-platform Mod on the Curseforge Platform with the designated ARK:SA Devkit that will be provided to you by Overwolf, to develop a cross-platform Mod for ARK. Upload and Submit the Mod through the Devkit accordingly. Mods will be published on Curseforge.com only subject to a moderation review conducted by Overwolf and subject to the applicable Moderation Guidelines (see section 4.3(i) below). Only Mods that were reviewed, approved and published on Curseforge.com prior to the End Date of the Promotion, shall be considered as Eligible Entrant to the Promotion.
      4. When submitting a Map Mod or Everything Else Mod, each Entrant should ensure it is accurately categorized (e.g., a “Creature Mod” shall not be categorized under “Maps” Mod, or vice versa).
      5. Modders Track will also automatically include already approved cross-platform ARK mods previously published by existing Creators through the CurseForge Platform. Creators don not need to re-submit such Mods in order to be eligible for the Promotion.
    2. The “Studious Track” Submission Criteria:
      1. This Track is open for game studios or a team of individuals (minimum 3 individuals in a team) (“Studios”) with a proven background in Unreal Engine 5 game development, that wish to develop and submit a high-level premium downloadable content (DLC) (“Premium Mods”).
      2. Studios will be required to submit a proposal of the Premium Mod, for a first stage of review of the concept by Overwolf. In order to submit a Premium Mod proposal, the Entrant required to access the landing page which will be available during the Promotion Period in the following link: arkathon.curseforge.com and fill in a Submission Form addressing the preliminary idea of the Premium Mod (the “Premium Mod Proposal”).
        Note: Submission of the Submission Form for the Premium Mod Proposal is through monday.com services. By Submitting your Premium Mod through the Submission Form by Monday.com, you hereby acknowledge that you have read and accepted Monday.com’s Terms of Service and Privacy Policy which are available in the following link.
      3. Each Submitted Premium Mod Proposal shall be reviewed by a designated team at Overwolf (the “Review Team”) for the proposal’s eligibility under these official rules. Only Premium Mods Proposal that the Review Team shall consider, under its sole discretion, to qualify for the Studios Track and as a Premium Mod, shall be eligible to enter the Promotion in the Studios Track (“Qualified Premium Mods”). The Review Team shall contact Entrants with the result of the review. Premium Mod Proposals that were not qualified as a Qualified Premium Mod by the Review Team can submit their proposed Mod as a cross-platform Mod under the Modders Track and participate in the promotion under the Modders Track. Overwolf’s decision under this section is final and binding and non-appealable.
      4. Entrants that their Premium Mods have been qualified by the Review Team as Qualified Premium Mods by Overwolf Review Team, shall be required to submit a full concept of their Premium Mod. The full concept shall include, without exhausting, a “Kickstarter-like” video, showcasing the idea of the Premium Mod, the team members, the vision of the Premium Mod and also submitting a Game Design Document (GDD) (“Full Premium Mod Concept”). Note: Submission of a Full Premium Mod Concept may require Entrants to provide additional information and details about the Entrants, and all subject to the Promotion Privacy Notice (Annex A to these Official Rules below). Further, the qualification process and to be considered under the Studios Track, Entrants may be required or subject to the fulfillment of additional conditions, as set forth in these Official Rules or as may be asked or required by Overwolf, under its sole discretion.
    3. Additional General Rules for Submission in the Modders Track and the Studious Track:
      1. All submitted Mods, whether in the Modders Track or the Studios Track, must adhere to both CurseForge Moderation Policies and Studio Wildcard Modding Guidelines (“Moderation Guidelines”) which are available in the following links: https://support.curseforge.com/en/support/solutions/articles/9000232898-moderation-guidelines-for-ark-survival-ascended Each Entrant should note that each Mod Submitted and/or Premium Mod Proposal and/or Full Premium Mod Concept will be subject to a review under these Moderation Guidelines. Overwolf and/or Studio Wildcard may, under their sole discretion, disqualify any Submission and/or Mod as well as removing any Mod published through the CurseForge Platform, in the event such Mod fails to follow the Moderation Guidelines. Overwolf may also revoke or disqualify any Entitled Winner. Overwolf’s decision under this section is final and binding.
      2. Without derogating from any rules applicable (including any applicable CurseForge’s Terms of Service and/or the Developers Terms and/or Studio Wildcard terms of service/use or the the Moderation Guidelines), each Entrant hereby acknowledges, accepts and declare that each Mod submitted and/or Premium Mod Proposal and/or Full Premium Mod Concept is an original work of the Entrant. By making a Submission, an Entrant hereby declares and acknowledges that they have observed all intellectual property rights and accordingly warrant that the creation of the Mod and the Submission does not violate, misappropriate, or infringe any third-party Intellectual Property rights or publicity or privacy rights, including and without exhausting, any copyright. Submissions may not feature any trademarks (including logos) other than those owned by Overwolf and/or Studio Wildcard.
      3. Submissions and/or Mods must not include any virus, worm, adware, spyware or other malicious software, or any software or programs which could violate the rights of any user (including Entrants), including their Privacy rights, and/or send messages (including emails or SMS) to any person that such a person could possibly find to be abusive, harassing, needlessly repetitive, or any messages that violate any applicable law, rule or regulation.
      4. Any use of figures and images of a real person shall be subject to written permission from that person or those people to use their image in the Mod. Entrants must provide such permission upon request by Overwolf.
      5. The art and creatives of the Mod or Submission must relate to the storyline or characters of the Game and align with the Game’s style and spirit. The Mod should be submitted in a form such that it can be used as a Mod available for download to the Game and can be used by the Game’s users for all available platforms.
      6. Subject to the Moderation Guidelines, and without derogating, it is hereby clarified that Mods should not contain any inappropriate content, including any direct or implied images of alcohol, cigarettes, drugs, nudity or otherwise objectionable content.
      7. Mods shall not include real life or famous or well-known imagery or artwork (paintings, models, sculptures etc.), unless permission for the use of it is provided by the authorized entity. For example – using images or imagery of famous buildings, traffic signs, street names etc., might be subject to Intellectual Property protection and may require pre-authorization for the use.
      8. The Number of Submissions is not limited. You can upload different Mods simultaneously and each will be considered as an Entry for the Promotion, provided that: (1) all Mods and Submissions follow these Official Rules and the Submission Criteria; (2) Duplicated Mods will be disqualified and only one Mod, subject to Overwolf’s sole discretion, shall be considered as an Entry. Be aware that multiple Submissions of the same or highly similar Mod/s or Premium Mode Proposals will not increase the chances of winning a Prize.
      9. An Entrant may change, alter, edit or re-submit an Entry provided it was made during the Promotion Period.
      10. It is hereby clarified, that by making a Submission, an Entrant hereby acknowledges that he has read and accepted also the Terms and Conditions and Privacy Policy of the Game and Studio Wildcard.
    4. Without derogating anything from the above, each Entrant hereby acknowledges that all Submissions will be prescreened to ensure compliance with the Submission Criteria, Eligibility Requirement and with Moderation Guidelines and Overwolf general standards and practices prior to refer them to the Community Vote or the Judging Panel (“Qualified Submissions”). Overwolf will have the sole right to refuse Mods or Submissions or disqualify Mods or Submission/s and/or disqualify or prohibit an Entrant from participating in the Promotion (or alternatively disqualify a Potential or entitled Winner), based on reasons such as: quality of Mod; a failure to meet Eligibility requirements; Entrant that did not provide applicable contact details; Mods or Submissions that include inappropriate content; in the event an Entrant is found to be acting in violation of these Rules, or found to be acting in an unsportsman-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Promotion, or to annoy, abuse, threaten or harass any other person, and/or in the event that the Sponsor has reason to believe that the Mod include a possible infringement of third party copyright or other intellectual property rights infringement/s. Overwolf reserves the right to seek damages and/ or other remedies from any such Entrant to the fullest extent permitted by law.
  5. SELECTION OF WINNER/S.
    1. Modders Track:
      1. Judging Panel. The Judging Panel will be composed of 3 Judges with extensive experience and knowledge in ARK modding. The Judging Panel will include judges from Overwolf, Studio Wildcard and an additional independent judge.
      2. Finalist list by the Judging Panel. Following the End Date, the judges panel will review and judge Qualified Submissions and will select 16 Finalists: 6 Maps Mods and 10 “Everything Else” Mods (“Finalists”). The Judging Panel will judge the Qualified Submissions based on the following criteria: (a) Originality – Creativity, novelty, uniqueness of the Mod (30%) (b) Enjoyability - the playability aspect of the Mod and its fitness to the Game (30%); (c) visual esthetic aspect of the creation (30%); (d) Popularity – will be evaluated by the number of downloads of the Mod on CurseForge at the time of judging (10%) (each and all are the “Judging Criteria”).
      3. Community Vote. All Finalists’ Mods will be announced and published for a Vote. The Vote will be published and available for voting by the ARK community available in the following link: arkathon.curseforge.com between February 12, 2024 and February 24th, 2024 (“Voting Period”). No extensive changes to the Submission (expect regular maintenance and updates to a published Mod) will be made or accepted during the Voting Period. The Vote shall be subject to validation and verification process by Overwolf. For avoidance of doubt, no mechanically reproduced or automatic actions of any kind (including Bots) are allowed in the Vote. In the event that Overwolf has reasonable grounds to believe that such tools have been used in the Vote, whether by an Entrant or any third party, or in the event of repeat cases of infringement of this section and the integrity of the Vote, Overwolf reserve the right to disqualify: (a) the vote/s; and/or (b) the Submission or an Entry from the Promotion; and/or (c) a Potential Winner.
        Note: Finalists may be required to fulfill and return to Overwolf a Finalist Confirmation (subject to section 5.3(i) below) prior to the Vote. A failure to provide the Confirmation Notification prior to the Vote, as requested by Overwolf, may result in disqualifying a Finalist.
      4. Potential Winners. Following the end date of the Vote, a total of 8 Potential Winners will be selected in the Modders Track( the “Potential Winners”): (a) One (1) Map Mod which received the most votes in the Vote; (b) One (1) Everything Else Mod which received the most votes in the Vote (3) two (2) additional Maps Mods and 4 additional Everything Else Mods that will be chosen amongst the Finalist by the Judging Panel.
      5. In the event of a tie in the Vote, the two 2 Mods that received the highest votes will qualify as Potential Winners, and the Judging Panel will select the remainder of the Potential Winners amongst the Finalist and up until 8 winners in total (3 Maps Mods and 5 Everything Else Mods).
    2. “Studios Track”
      1. Judging Panel. Qualified Premium Mods (as qualified in accordance with section 4.2 above) will be brought before the Judging Panel. The Judging Panel will be composed of 3 Judges with extensive experience and knowledge in ARK modding. The Judging Panel will include judges from Overwolf, Studio Wildcard and an additional independent judge.
      2. Finalist list by the Judging Panel. Following the End Date, the Judging Panel will judge the Qualified Premium Mods and will select up to 10 Finalists. The Judging Panel will judge the Qualified Premium Mods based on the following criteria: (a) Originality – Creativity, novelty, uniqueness of the Mod (30%) (b) Enjoyability - the playability aspect of the Mod and its fitness to the Game (30%); (c) visual esthetic aspect of the creation (30%); (d) Studio credentials - team size, background and experience, past work etc. (10%) (each and all are the “Judging Criteria”);
      3. Community Vote. will be announced and published for a Vote. The Vote will be published and available for voting by the ARK community available in the following link: arkathon.curseforge.com between February 12, 2024 and February 24th, 2024 (“Voting Period”). No changes to the Submission will be made or accepted during the Voting Period.
        The Vote shall be subject to validation and verification process by Overwolf. For avoidance of doubt, no mechanically reproduced or automatic actions of any kind (including Bots) are allowed in the Vote. In the event that Overwolf has reasonable grounds to believe that such tools have been used in the Vote, whether by an Entrant or any third party, or in the event of repeat cases of infringement of this section and the integrity of the Vote, Overwolf reserve the right to disqualify: (a) the vote/s; and/or (b) the Submission or an Entry from the Promotion; (c) a Potential Winner.
      4. Potential Winners. Following the end date of the Vote, a total of 3 Potential Winners will be selected in the Studios Track (the “Potential Winners”): (a) One (1) Qualified Premium Mod which received the most votes ; and (b) two (2) Qualified Premium Mods that will be chosen amongst the Finalist by the Judging Panel.
      5. In the event of a tie in the Vote the two 2 Qualified Premium Mods that received the highest votes will qualify as Potential Winners, and the Judging Panel will select the remainder of the Potential Winners amongst the Finalist and up until 3 winners in total.
    3. Finalists and Winners Announcements and Notifications.
      1. Finalists Notification and confirmation. Finalists will be notified of their status as Finalists at the email address provided by Entrants at time of Submission within three (3) business days following the Judging Panel decision or such other time as reasonably required by Overwolf for such notification (“Finalist Notification”). Upon the Finalist Notification the Entrants shall have three (3) business days from the date such notice was emailed to respond and provide any information or materials requested by Overwolf, including an Acceptance and Release and/or Affidavit of Eligibility, and/or Liability Release and/or a Release Form (“Release”), if such required (“Finalist Confirmation”). Finalist Confirmation should be delivered to the email address specified in the Finalist Notification. The failure by any Finalist to timely respond may result in disqualification of the Finalist by Overwolf and Overwolf may select another Finalist/s instead.
      2. Winners Notification. Potential Winners who were selected in accordance with sections 5.1 and 5.2 above, will be announced within seven (7) business days following the Judging Panel’s decision. The announcement will be published on the CurseForge Twitter page. (“Winner Notification”).
      3. Entitled Winners Prize Claims Documents. To be entitled to a Prize, Potential Winners may be required to execute additional documentation required in order to be entitled with a Prize, including additional releases and/or agreement (such as the Fund Agreement in the Studios Track, subject to section 7.2 below) (collectively, “Prize Claim Documents”). In the event that: (i) the Potential Winner refuses to sign and return such Prize Claim Documents within an appropriate period specified by Overwolf or did not reply to the Winner Notification within the specified period within the Prize Notification, no matter the cause or reason for such failure to reply, the Potential Winner or the Entrant may be disqualified by Overwolf. Overwolf may select another Potential Winner in their place from among the remaining Finalists.
  6. Limitations, Restrictions and conditions presented:
    1. Only Mods submitted following section 5 above within the Promotion Period shall be entitled to participate in the promotion. No late entries and submissions will be enabled or accepted.
    2. Multiple Entries are allowed, subject to section 4 of these Official Rules above. However, only one Prize can be awarded to every Entrant. An Entrant cannot win multiple Prizes. In the event that an Entrant submitted 2 or more Mods or Submissions, Overwolf shall award the Entitled Winner with the Prize for the Mod that received the higher score/vote in accordance with section 5 above. In such a case, and subject to the Judging Panel decision as described in section 5 above, Overwolf shall entitle additional Entitled Winner for a Prize.
    3. Employees, officers, directors, representatives, and agents of Overwolf and/or Studio Wildcard and their affiliated companies, subsidiaries, and the advertising and promotion agencies which conduct this Promotion, and each of their immediate family members (i.e. spouse, parent, child, sibling, and their respective spouses and the “steps” of each, regardless of where they reside) and persons living in the same household of each, whether or not related, are not eligible to enter the Promotion or win a Prize.
  7. Prize/s.
    1. Available Prizes for Winners are:
      Modders Track Studios Track
      1. Map Mode – CurseForge Authors Rewards Program points in the value of $10,000 for each Winner (3 Winners total);
      2. Everything Else Mod - CurseForge Authors Rewards Program points in the value of $4,000 for each Winner (5 winners total)
      $100,000 Development Grant for each Winner (3 Winners in total)
      Total Prizes: 8, in the Value of 50,000 USD Total Prizes 3, in the value of 300,000 USD
    2. Prize Redemption process and special conditions.
      1. Receiving the Development Grant in the Studios Track is a milestone-based Grant for the development of the Full Premium Mod Concept that was elected as a Winner. The Grant and entitlement for the Prize in the Studio Track is subject to Overwolf Creator Fund Program . Redeeming the Prize and entitlement for the full Grant is subject to a Fund Agreement to be signed by the Winner with Overwolf and subject to the terms and conditions set forth therewith. No Prize or any grant or fund shall be granted otherwise.
      2. The redemption of the Prizes in the Modders Track is by and through CurseForge Authors Rewards Program (the “Reward Program”) and subject to its terms and conditions. By accepting the Modders Track Prize, the entitled Winner acknowledges, agrees and accepts to be bound by the Reward Programs terms and conditions.
      3. Only the type and quantity of Rewards described in these Official Rules will be awarded. No cash alternative or substitution will be allowed, however Overwolf reserves the right to substitute comparable rewards of equal or higher value if any such rewards listed above is unavailable, in whole or in part, for any reason.
      4. Where required under applicable laws, each Winner shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the Prize or any applicable prize.
  8. RIGHTS IN SUBMISSIONS. For good and valuable consideration, the receipt and legal sufficiency of which is hereby acknowledged, each entrant hereby irrevocably grants to Overwolf and/or Studio Wildcard and their successors, licensees and assigns, an exclusive license (but not the obligation) to reproduce, publicly perform, publicly display, stream, exploit, make derivative works of and otherwise use the Submission, in whole or in part, for any purpose, including without limitation commercial purposes, in any and all media now or hereafter devised throughout the universe in perpetuity. Overwolf and/or Studio Wildcard shall have the right, in their sole discretion, to edit, composite, morph, scan, duplicate, or alter the Submission for any purpose which the Sponsor deem necessary or desirable, and each entrant irrevocably waives any and all so-called “moral rights” they may have therein. Overwolf and/or Studio Wildcard shall retain the rights granted in each Submission even if the Submission is disqualified or fails to meet the Submission Requirements or even if it is determined that the entrant who made the Submission is ineligible to enter the Promotion.
  9. LIMITED LICENSE TO ENTRANTS. Without derogating anything in any other legal binding document between the Entrants and/or Potential Winners and Winners, which apply on any engagement of such with Overwolf and/or Studio Wildcard (including any applicable terms of services and conditions), Overwolf and/or Studio Wildcard hereby grants Entrants a non-exclusive royalty-free license to use, publicly display and perform, distribute and display the trademarks, including logos and materials from the Game (e.g., screenshots, etc.) (the “Marks”) provided that the use will be solely in and for the Submission to the Promotion. Except as expressly provided herein, Overwolf and/or Studio Wildcard retain all rights, title and interest, including all Intellectual Property rights, in and to the Game, the Curseforge Platform and any other Marks, and Overwolf and/or Studio Wildcard retains all rights, title and interest their trademarks, logos and service marks. All rights not expressly granted herein are reserved.
  10. REPRESENTATIONS AND WARRANTIES/INDEMNIFICATION: Each entrant represents and warrants as follows: (i) the Submission does not and will not violate or infringe upon the intellectual property rights or other rights of any other person or entity; (ii) the Submission meets the Submission Criteria and Moderation Guidelines and does not and will not violate any applicable laws, regulations or applicable policies and is not and will not be defamatory or libelous. Each entrant agrees to indemnify Overwolf and Studio Wildcard and hold them harmless from and against any and all third party claims, liability, judgments, losses, damages, costs, and expenses, including penalties, interest and reasonable outside attorney’s fees and costs in the defense and disposition of such matters arising out of, resulting from, based upon or incurred because of a breach or allegation that, if true, would constitute a breach by entrant of his or her representations, warranties, covenants or obligations hereunder, including, without limitation, any action or statement made by entrant while participating in the Promotion.
  11. PUBLICITY RELEASE: Without in any way limiting the rights granted in the Submission, and subject to any further Release provided by the Entrant, as set forth above, Entrants hereby acknowledges and accept that a Submission to the contest constitutes a permission for Overwolf and/or Studio Wildcard to use each Entrants name, social media handle, photograph, likeness, voice, biographical information, statements and address (city and state) in and in connection with advertising, marketing, promotional, and/or publicity purposes for the Promotion, and all uses of the Submission permitted herein, worldwide and in all forms of media and by any and all means and media now known or hereafter developed, in perpetuity, without any obligation, notice, or further compensation to the Entrant. Entrants hereby release Overwolf and Studio Wildcard from any liability with respect thereto.
  12. NATURE OF RELATIONSHIP/WAIVER OF EQUITABLE RELIEF: Each entrant hereby acknowledges and agrees that the relationship between the entrant and Overwolf or Studio Wildcard is not a confidential, fiduciary, or other special relationship, and that the entrant’s decision to provide the entrant’s Submission to Overwolf or Studio Wildcard for purposes of the Promotion does not place Overwolf or Studio Wildcard in a position that is any different from the position held by members of the general public with regard to elements of the entrant’s Submission. Each entrant understands and acknowledges that Overwolf or Studio Wildcard have wide access to ideas, stories, designs, and other literary materials, and that new ideas are constantly being submitted to Overwolf or Studio Wildcard or being developed by their own employees. Each entrant also acknowledges that many ideas may be competitive with, similar or identical to the Submission and/or each other in theme, idea, plot, format or other respects. Each Entrant acknowledges and agrees that such Entrant will not be entitled to any compensation as a result of Overwolf or Studio Wildcard use of any such similar or identical material. Each Entrant acknowledges and agrees that Overwolf or Studio Wildcard do not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the copyright in and to the Submission. Finally, each Entrant acknowledges that, with respect to any claim by entrant relating to or arising out of Overwolf or Studio Wildcard actual or alleged exploitation or use of any Submission or other material submitted in connection with the Promotion, the damage, if any, thereby caused to the applicable Entrant will not be irreparable or otherwise sufficient to entitle such entrant to seek injunctive or other equitable relief and Entrant’s rights and remedies in any such event shall be strictly limited to the right to recover damages, if any, in an action at law.
  13. NO OBLIGATION TO USE: Overwolf or Studio Wildcard shall have no obligation (express or implied) to use any Submission, or to otherwise exploit any Submission or, if commenced, to continue the distribution or exploitation thereof, and Overwolf or Studio Wildcard may at any time abandon the use of the Submission for any reason, with or without legal justification or excuse, and entrants shall not be entitled to any damages or other relief by reason.
  14. DATES & DEADLINES/ANTICIPATED NUMBER OF CONTESTANTS: Because of the unique nature and scope of the Promotion, Overwolf and/or Studio Wildcard reserve the right, in addition to those other rights reserved herein, to modify any date(s) or deadline(s) set forth in these Official Rules or otherwise governing the Promotion. Overwolf or Studio Wildcard cannot accurately predict the number of Entrants who will participate in the Promotion.
  15. FURTHER DOCUMENTATION: If Overwolf and/or Studio Wildcard shall desire to secure additional assignments, certificates of engagement for the Submission or other documents as may reasonably require in order to effectuate the purposes and intents of these Official Rules, then each Entrant agrees to sign the same upon Overwolf or Studio Wildcard request therefor.
  16. LIMITATION OF LIABILITY. Overwolf or Studio Wildcard will not be liable in case of (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Promotion; (iv) electronic or human error which may occur in the administration of the Promotion or the processing of entries; (v) failure of Overwolf to supply/provide the Prize or any part thereof, by any reason of any act of God, fire, natural disaster accident, or act of government, or any other cause beyond the Overwolf’s sole control; (vi) incorrect or inaccurate entry information whether caused by internet users or by any of the equipment or programming associated with or utilized in the Promotion or by any technical or human error which may occur in the processing of the entries in the Promotion; and (vii) for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries. Nothing in this section 16 shall exclude Overwolf from any liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, willful misconduct, gross negligent behavior, a slightly negligent breach of its primary obligations (i.e. contractual obligations that need to be fulfilled to permit proper execution of these Official Rules and that may regularly be relied upon by the Entrants), or for any other liability whose limitation is prohibited by law.
  17. GENERAL CONDITIONS
    1. The receipt of the Prize is conditioned upon compliance with any and all federal, state and other local laws and regulations. Any violation of these Official Rules by any Entrant, Finalist and/or Winner will result in his disqualification and all privileges as Winner or Finalist will be immediately terminated.
    2. Overwolf reserve the right to modify, extend, suspend, or terminate the Promotion if it determines, that the Promotion is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond the Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Promotion as contemplated herein.
    3. In the event that Overwolf is prevented from awarding Prizes or continuing with the Promotion as contemplated herein by any event beyond their control, including but not limited to fire, flood, natural or man-made epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within their control (each a “Force Majeure” event or occurrence), then Sponsor and Administrator shall each have the right to modify, suspend, or terminate the Promotion.
    4. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Overwolf. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision of these Official Rules is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
    5. Governing Law. These Terms and any claim related to these Terms will be governed by and interpreted under the laws of Israel. Notwithstanding the foregoing, any overriding consumer protections which apply under the law of the country you reside in will continue to apply to you. Any dispute arising from these Terms will be subject to the jurisdiction of the courts of Tel Aviv-Jaffa, Israel, save to the extent that you have a right under the law of the country in which you reside to bring a claim before appropriate authorities or courts in the country in which you reside.
    6. Promotion Privacy Notice. By entering the Promotion, each Entrant acknowledges that they have read and accepted the Promotion Privacy Notice attached herein to these Official Rules as Annex A, and that any of the Entrant’s information made available to Overwolf and/or Studio Wildcard in connection with the Promotion and for the execution and performance of the Promotion will be treated in accordance with the Promotion Privacy Notice accordingly.
    7. Supremacy. In all matters related to the Promotion, these Official Rules shall supersede any contradictory terms contained in any other Overwolf’s Terms or Policies. Nothing in this section shall mean or read to derogate from anything in the Terms of Services which related to Overwolf services and /or the Curseforge Platform and in any event of contradiction between these Official Rules and the Curseforge Platform or Overwolf terms and conditions, such terms that govern the services, shall prevail.
    8. Social Disclaimer. Entrants should understand that they provide their information (such as email, name and contact details) to Overwolf or Studio Wildcard but not to other third parties such as social networks, including Facebook, Google, YouTube, Twitter (X) etc. (“Social Networks”). Also, this Promotion is in no way sponsored, endorsed, administered or associated with any social networks as such. Entrants hereby agree to indemnify these social networks from any and all liability related to this Promotion. Where applicable and required, Entrants may be required to accept the Terms and Conditions of the Social Networks, including YouTube, in order to participate in the Promotion.
    9. Publication of Official Rules: These Official Rules will be available to Entrants on arkathon.curseforge.com during the Promotion Period and at least until all Winners of this Promotion have been provided with their Prize.

ANNEX A - PROMOTION PRIVACY NOTICE

Overwolf Ltd and its affiliates (“Overwolf” or “we”) is dedicated to protecting the privacy rights of our online users (“users” or “you”). This Promotion Privacy Notice (the “Notice”) has been provided to inform you as to the ways we collect, store, use, and manage (“process”) your personal information when you participate in the promotions organized by us (“the Promotion”).
“Personal information” means any information relating to an identified or identifiable natural person, thus who can be identified, directly or indirectly.

Overwolf Privacy Policy and the Terms and Use for our website (collectively, the “Site”), or any Overwolf platforms and services (the Site, platform and services of Overwolf shall be collectively referred to as the “Service”) apply to the use of our Services when participating in the Promotions as well. Please note that the scope of this Notice is limited only to information collected by Overwolf through a participation in the Promotion. This Notice does not apply to the practices of third parties that Overwolf does not own or control.

Overwolf is the controller of your personal information collected within the Promotion and will process your personal information in accordance with applicable law. If you do not agree to this Privacy Notice, please do not participate in our Promotions.

Processing of your personal information for the performance of the Promotion
If you choose to participate in our Promotions, we may ask you to provide information such as: name, e-mail, physical address and location, date of birth, professional background, picture and images, etc.,]. We process this information so that you can participate in our Promotions and so that we can send you (directly by us or by a third party which is a qualified subcontractor of us) Notifications such as Winner Notification or any communication related to the Promotion and your participation accordingly.
If you contact us via email (e.g., to contact customer support), we will collect the content of the e-mail. We may use your personal information submitted in your communications to contact and respond to you.
In the cases outlined above the legal basis for processing your personal data is the performance of a contract.

Your personal information will be used primarily for the purposes of managing and administering the Promotion, including contacting you if you are a winner and to respond to your inquiries as outlined above.

To protect the safety, rights, property, or security of Overwolf, the Service, any third party (such as Studio Wildcard), or the general public; to detect, prevent or otherwise address fraud, security or technical issues; to prevent or stop activity which may be consider to be, or to pose a risk of being, an illegal or legally actionable activity; to use as evidence in litigation; and to enforce this Notice and our Promotion Official Rules.
The legal basis for processing your personal data in this regard is our legitimate interest to protect our site and/or Services, defend our rights and to prevent and track unauthorized activities.
Legal compliance. To comply with applicable legal or regulatory obligations, including as part of a judicial proceeding; to respond to a subpoena, warrant, court order, or other legal process; or as part of an investigation or request, whether formal or informal, from law enforcement or a governmental authority.
Corporate Transaction. We may transfer your personal information to third parties as part of a corporate transaction (Asset Deal).
Publication of your name as a winner. In case you are a winner of the Promotion we might ask to publish your name on a winner’s list provided you have consented to a respective publication.
We do not perform automated decision making (including profiling).

Sharing of personal information with third parties
We do not sell the personal information we collect. We do, however, disclose personal information as described in this policy. In the past 12 months, we have disclosed personal information to the following categories of recipients:
Other Overwolf or ARK users. If you win a Promotion, we may share and publish your name with regards to the winner publicly, with other Overwolf or Studio Wildcard and the Game users and/or the community, provided you have given your consent to do so.
Third parties for legal, fraud prevention, and security purposes. We may share your information with third parties as required by legal or regulatory obligations; as requested by law enforcement or other government officials in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose you or us to legal liability; or as Overwolf otherwise deems necessary to detect, prevent, or otherwise address fraud, security, technical issues, or other threats to Overwolf or others.

Third-party service providers and Partners. insofar as it is reasonably necessary for the purposes set out in this privacy notice, we may share your personal information with third party companies that perform services on our behalf such as: hosting services, customer service, subcontractors and service providers of Promotion. While providing the services for us, these companies may access your personal information, and are required to use it solely as directed by us for the purpose of our requested service or if you granted your consents specifically for providing your details to these third parties in the curse of the Promotion. Under the same conditions, we may partner with a third party as specified in the Promotion Official Rules in order to assist us fulfill our obligations to you under our Promotion Official Rules.

Third parties in the context of a merger, acquisition, corporate transaction, or other legal process. We may disclose your information to another entity in connection with, an acquisition or merger, sale or transfer of a business unit or assets, bankruptcy proceeding, or as part of any other similar business transfer.

International Transfers
We may transfer your personal information outside your country of residence, including possibly to countries that do not provide a level of data protection equivalent to your country of residence. Please note that Overwolf is located in Israel, a country that is deemed to provide an adequate level of data protection according to an adequacy decision of the European Commission. Where Overwolf onward transfers your personal information to a company located outside of Israel, we will take steps to ensure that your information is given a similar level of protection as that given in Israel or the EU by concluding relevant standard contractual clauses. You have the right to request from us information about, including a copy of, the contractual safeguards Overwolf puts in place to achieve this.

Data retention
We will keep your information for as reasonably necessary for the purposes set out above in accordance with applicable law, generally no longer than 3 years from the date you stopped using our Services. To determine the appropriate retention period, we will consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process the personal information and whether we can achieve such purposes through other means, as well as applicable legal and regulatory requirements.

Security
We have implemented technical, physical, managerial and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration or disclosure. However, please note that no system or network is 100% secure and we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use, disclose, or alter your personal information for improper purposes.

Your rights and choices in relation to your personal information
Subject to the respective legal requirements, you are entitled to the following data protection rights:
You have the right to request information from us about the personal information we hold in relation to you and correct any inaccurate data we hold
You also have rights to request that we delete any personal information about you, if you decide to delete or anonymize your personal information, you may no longer be able participate in our Promotions.
You also have a legal right to ask for a restriction of processing and the right to data portability.
You also have the right to withdraw your consent, on the basis of which we process your personal information, at any time. However, this does not affect our lawful processing based on your consent before this withdrawal. You may object to processing based on our legitimate interests, on grounds relating to your particular situation. In this case, we will re-examine the corresponding data processing. The California Consumer Privacy Act or “CCPA” provides consumers residing in California certain rights with respect to their personal information. Policy regarding Minors
The terms of our services as well as our Promotion Official Rules prohibit users aged under 18 years from using our Services and/or participating in our Promotions and we do not knowingly collect data relating to minors under the age of 18.
If we become aware that personal information from a child has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. Frequently Asked Questions

  • For Modders - yes. To participate in the Modders Track, modders need to publish their mods to CurseForge. While modders can use the dev kit and build mods without a CurseForge account, once you want to publish your mod, you must sign in with a CurseForge account.
    For Studios - no. To participate in the Studios Track, studios only need to send over a “kickstarter-like” video explaining their vision and team.

  • Cross platform. Participation in both the Modders Track and the Studios Track, is only eligible for cross-platform mods.

  • In the Modders Track there will be a total of 8 winners - 3 maps will win $10,000 each, and 5 “everything else” mods will win $4,000 each.
    In the Studios Track there will be 3 total winning studios, with each winning a $100,000 development grant.

  • For each track, a panel of judges from Studio Wildcard and CurseForge will select finalists - then put them up for community voting.

  • Community voting will be done on the X platform (formerly known as Twitter).
    Once finalists have been selected, CurseForge will publish a unique tweet for each finalist. To cast your vote, you’ll need to like that finalists’ CurseForge tweet. All finalists' tweets would also be accessible from the CurseForge voting hub page.
    There is no limit to how many finalists you can vote for, but a valid X account is needed to take part in the community voting.
